Rental Agreement

This Rental Agreement is made at Bengaluru on ____________ between ________________________, residing at ________________________________________ (the “Landlord”), and ________________________, whose permanent address is ________________________________________ (the “Tenant”). Each is a “Party”.

The Landlord owns the residential 2 BHK premises at Flat/House No. ____, ________________, BTM Layout, Bengaluru, together with the fittings listed in Annexure A (the “Premises”), and agrees to let them to the Tenant on these terms:

1. Term. Eleven (11) months, from ____________ to ____________. It may be renewed by written agreement of both Parties. On renewal the rent shall not increase by more than 5%.
2. Rent. ₹30,000 per month, payable in advance on or before the 5th of each month by bank transfer to an account the Landlord names in writing. The Landlord shall give a rent receipt for every payment on request. Maintenance charges are included in the rent.
3. Security deposit. The Tenant has paid an interest-free deposit of ₹1,00,000. The Landlord shall refund it within 15 days of the Tenant handing back the Premises and keys. The Landlord may deduct only (a) unpaid rent or utility bills up to the handover date, and (b) the reasonable cost of repairing damage beyond normal wear and tear, each supported by bills or photographs and listed in writing. No repainting charge shall be deducted for normal wear and tear. Normal wear and tear includes fading paint, minor wall marks, and wear of fittings from ordinary use.
4. Water. The Premises are supplied by BWSSB (Cauvery) and borewell. The Landlord shall ensure water adequate for normal domestic use and shall keep the pump, tank and plumbing in working order. Water tankers bought because of a shortfall in the regular supply shall be paid for by the Landlord. Any water bill in the Tenant’s period is paid as per Clause 5.
5. Electricity and other utilities. The Tenant shall pay electricity, water and gas bills for the Term, based on meter readings recorded in Annexure B on the start date. The Landlord shall pay all dues up to that date. No power backup is provided.
6. Gas. LPG cylinder connection to be transferred by the Landlord. The Landlord shall complete the transfer within 30 days of the start date.
7. Internet. The Tenant may install broadband or cable services, and the Landlord shall permit reasonable cabling. The Tenant shall remove it on leaving if asked.
8. Repairs. The Landlord shall carry out, at the Landlord’s cost and within a reasonable time, structural repairs and repairs to wiring, plumbing, the water pump, seepage and leakage. The Tenant shall pay for small repairs caused by day-to-day use, up to ₹1,000 each.
9. Use. The Premises shall be used only as a residence by the Tenant and family or co-occupants named to the Landlord. The Tenant shall follow the reasonable rules of the building or association. The Tenant shall not sublet without the Landlord’s written consent.
10. Landlord’s visits. The Landlord may enter the Premises only at a reasonable time and with at least 24 hours’ notice to the Tenant, except in an emergency.
11. Notice and termination. Either Party may end this Agreement by giving 1 month(s)’ written notice. There is no lock-in period. The Landlord shall not cut water or electricity or change the locks to force the Tenant out.
12. Handover. At the start and end of the Term the Parties shall inspect the Premises together. Date-stamped photographs taken by either Party at those inspections, and the inventory in Annexure A, form part of this Agreement.
13. Stamp duty and registration. This Agreement shall be executed on e-stamp paper of the value applicable in Karnataka, paid by the Tenant. Either Party may have it registered.
14. Disputes. The Parties shall first try to settle any dispute by discussion. Courts at Bengaluru shall have jurisdiction.
